Domestic Partner/Same Sex Issues
Arizona is not a “gay friendly” state. The conservative political environment in Arizona has resulted in same-sex parenting, custody and property division issues becoming tremendously taboo. The Court of Appeals has further limited the ability for same-sex couples to share custody in a case called Thomas v. Thomas.
Our attorneys are committed to the equal treatment of all people, irrespective of sexual orientation. Our understanding approach to the complexities of same-sex issues has led to our firm being sought out to consult on legislative issues pertaining to same-sex parenting issues. Additionally, Gregg is especially proud of the work he has done with the ACLU to advise equal rights for all parents irrespective of their gender and sexuality.
- Same-sex property issues: Representation of domestic partners in complex estate divisions
- Custody: Assisting same-sex parents to fashion parenting time schedules that enable both parents to be actively involved in the children’s lives.
- Adoption: Arguably, Arizona law currently does not allow same-sex couples to adopt. This creates a situation where one parent completes the adoption and the other has no legal rights. We have helped same-sex parents fashion parenting time agreements that are both enforceable and respect the non-legal parent’s legitimate interests
